Nevada State Legislature Reevaluating Eminent Domain Law
The Nevada State Assembly has just approved a measure intended to impose stricture standards for local governments to be able to invoke eminent domain and take control of private property for redevelopment. As reported by Reno’s KRNV news station, local governments currently only need to have the piece of property deemed a “blight.” The new bill, if it is approved by the Senate, would require that the specified property also meet a variety of additional criteria, and that the agency that intends to redevelop the property present the owner with an offer before approaching the government to intercede.
Considering the high demand and low inventories of new property in the Las Vegas area, eminent domain may become a more common issue in the not-too-distant future. If the bill is OKed by the Nevada Senate, property owners in Las Vegas and surrounding Clark County will be most likely to benefit, as they will gain additional protection against arbitrary seizure.
